SECURE AMERICA NOW FOUNDATION, SECURE AMERICA NOW TRAINING CENTER, PARACLETE CONSULTING GROUP; LLC
RELEASE, WAIVER, INDEMNIFICATION, HOLD HARMLESS,
AND ASSUMPTION OF THE RISK AGREEMENT
WHEREAS, in consideration of being permitted to purchase a single day pass to access the SECURE AMERICA NOW TRAINING CENTER located at 410 Nickerson Farms Rd. Seguin, TX. 78155 for use of premises, and for other good and valuable consideration, the receipt and sufficiency of which is hereby the acknowledged, Acknowledger agrees to the following:
Participation in self-led training to include private recreational shooting, official and unofficial led training, recreational shooting and shooting activities is voluntary and requires supervised and member led handling of firearms, loading and unloading firearms, shooting, discharging of firearms, drills, courses of fire, exercises and tests of physical agility, physical excursion, rapid heart rate, unconventional shooting positions in which I assume full responsibility for my own actions, safety, proper and improper weapons handling skills.
Acknowledger hereby acknowledges and agrees that Acknowledger is aware that firearms will be fired in close proximity to one another, spent and expired brass casings will be extracted from firearms, unconventional shootings positions may be performed, and varying tactics and techniques will be voluntarily performed by Acknowledger. Acknowledger hereby acknowledges and agrees that Acknowledger will be shooting in close proximity to barricades, obstacles, training devices, training aids and vehicles that require they perform constant safety and muzzle awareness and execute the posted Cardinal Safety Rules and posted Range Rules at all times.
Acknowledger hereby acknowledges and agrees that Acknowledger has volunteered to participate in training, exercises, drills and courses of fire while require physical excursion, running across varying surfaces, false and varying environments and uneven ground, lifting, rapid heart rate, excessive heat and cold and unconventional shooting positions in which I assume full responsibility for their own safety and liability. If I am injured in any capacity, I will not hold
SECURE AMERICA NOW; SECURE AMERICA NOW TRAINING FOUNDATION; SECURE AMERICA NOW TRAINING CENTER; PARACLETE CONSULTING GROUP LLC. and it’s designated owners, representatives, board of directors, liaisons(s) or contractors liable.
Acknowledger hereby acknowledges and agrees that Acknowledger has volunteered to participate in training, exercises, drills and courses of fire where he/she will voluntarily engage or shoot training aids constructed of steel, steel targets and steel frames in various shooting positions in which I assume full responsibility for my own safety and liability. I will never engage stationary or reactive steel less than ten yards from said target or target stand. I will always wear approved ballistic eye wear with protective side shields which I am responsible for providing. If I am injured in any capacity, I will not hold
SECURE AMERICA NOW; SECURE AMERICA NOW TRAINING FOUNDATION; SECURE AMERICA NOW TRAINING CENTER; PARACLETE CONSULTING GROUP LLC. and it’s designated owners, representatives, board of directors, liaisons or contractors liable.
SECURE AMERICA NOW; SECURE AMERICA NOW TRAINING FOUNDATION; SECURE AMERICA NOW TRAINING CENTER; PARACLETE CONSULTING GROUP LLC. and it’s Owners, Operators, Founders, Board Members, Range Liaison’s and Representatives shall not be liable for, and Acknowledger, on behalf of himself/herself and on behalf of his/her executors, personal representatives, administers, assignees, heirs and next of kin, hereby expressly releases the Owners, Operators, Founders, Board Members, Range Liaison’s and Representatives from any and all such claims and liabilities. Acknowledger hereby expressly assumes the full risk of training, exercises, drills, courses of fire, weapons handling and use of firearms.
Acknowledger furthermore waives for himself/herself and for his/her executors, personal representatives, administrators, assignees, heirs and next of kin, any and all rights and claims for damages, losses, demands and any other actions or claims whatsoever, which he/she may have or which may arise against
SECURE AMERICA NOW; SECURE AMERICA NOW TRAINING FOUNDATION; SECURE AMERICA NOW TRAINING CENTER; PARACLETE CONSULTING GROUP LLC. (including but not limited to the death of Acknowledger and/or any and all injuries, damages or illnesses suffered by Acknowledger or Acknowledger’s property), which may, in any way whatsoever, arise out of, be related to or be connected with: the course of instruction; the Premises, including any latent defect in the Premises; Acknowledger’s presence on or use of said Premises; Acknowledger’s property (whether or not entrusted to another); and, the discharge of firearms.
Acknowledger agrees to indemnity, hold harmless and deem
SECURE AMERICA NOW; SECURE AMERICA NOW TRAINING FOUNDATION; SECURE AMERICA NOW TRAINING CENTER; PARACLETE CONSULTING GROUP LLC. and its Instructors and Consultants, Assistant Instructors, Volunteers or Assistants from any and all fault, liabilities, cost, expenses, claims, demands or lawsuits arising out of, related to or connected with: Acknowledger’s presence at and/or participation in the course of instruction; the discharge of firearms by Acknowledger; Acknowledger’s presence on or use of the range, buildings, land and premises (“Premises”); and ,any and all acts or omissions of Acknowledger present or future.
Acknowledger hereby acknowledges, and agrees that Acknowledger will:
1. Treat all weapons as if they are loaded and know the weapons condition at all times
2. Never point a weapon at anyone or anything unless you intend to shoot
3. Keep your finger straight and off the trigger at all times and do not manipulate the trigger until my sites are on target and I have decided to fire the weapon
4. Know you target, its location, what is behind it, in front of it and never fire until ready
5. Never load a weapon behind the firing line
6. Never load a weapon off the firing line
7. Never point the muzzle of the weapon at your body, lower extremities or anyone else
8. When moving from one point to another never place your finger on the trigger until I have decided to shoot
9. I will wear quality ballistic approved eye and ear protection provided by myself and not Secure America Now, Secure America Now Training Center, Secure America Now Foundation or Paraclete Consulting Group
10. When engaging or when others are engaging steel targets, I will wear quality eye protection with side shields and understand Secure America Now, Secure America Now Training Center, Secure America Now Foundation or Paraclete Consulting Group are not responsible for ballistic fragmentation that could reflect back on to my body.
11. When engaging or when others are engaging steel targets, I will never be closer than 10 yards from a steel target and will wear protective eye wear at all times.
12. I acknowledge that eye and ear protection is not provided and is my responsibility and will be worn at all times on the range and during all live fire situations.
13. I acknowledge that no members, owners, representatives of SECURE AMERICA NOW; SECURE AMERICA NOW TRAINING FOUNDATION; SECURE AMERICA NOW TRAINING CENTER; PARACLETE CONSULTING GROUP LLC. are not present, not responsible, not liable for my actions and my actions are my responsibility and the responsibility of my hosting member.
Acknowledger’s participation in this training does not guarantee any certification or permit of any kind outside of their employer, sponsoring agency or any other agency.
Acknowledger hereby acknowledges and agrees that Acknowledger will adhere to the Range Safety Rules and any injury or death sustained at the negligence of myself or someone else is not the liability of the
SECURE AMERICA NOW; SECURE AMERICA NOW TRAINING FOUNDATION; SECURE AMERICA NOW TRAINING CENTER; PARACLETE CONSULTING GROUP LLC.
Acknowledger hereby acknowledges and agrees that Acknowledger has read this instrument and understands its terms and is executing this instrument voluntarily. The acknowledger furthermore hereby acknowledges and agrees that he/she has read, understands and will at all times abide by all safety rules, range rules, procedures and all other posted rules and procedures.
Acknowledger expressly agrees that this instrument is intended to be as broad and inclusive as permitted by law and that if any provision of this instrument is held invalid or otherwise unenforceable, the enforceability of the remaining provisions shall not be impaired thereby. No remedy conferred by any of the specific provisions of this instrument is intended to be exclusive of any other remedy, and each and every remedy shall be cumulative and shall be in addition to every other remedy now or hereafter existing at law or in equity or by statute or otherwise.
